Having an ios7 device requirement doesn't mean it requires ios7 to run. Just that the cut off is at the ipad2/iphone4s or whatever.
It very well could require iOS7, and that's just how they worded it to imply that older devices are definitely out. I know I'll be getting this at launch, but I'm not sure if I'll jump on the season pass right away. However, it seems like the season pass gets you some extras beyond just the episodes, so that's enticing. And I think $5 for a few hours of gameplay (plus any possible replays) is a good deal.
Yeah... kinda hoping it won't. I'm not too keen on upgrading my iPad 3 to iOS 7. Could be a dealbreaker.
$5 for the initial download and first episode. After that, it's $5 to download each episode they release, or you can buy the remaining 4 for $15 via the season pass. Each episode gives 2-3 hrs of gameplay.

But it probably won't make it work on iPod 4th gen, at least not without constant crashes due to unsufficient memory.
As a backer, you have had much more access to information about this game than others (myself included). But even then, they have talked about it on their podcast for the game, so it wasn't on short notice that they announced this limitation. Also, backing a KickStarter project is not the same as pre-ordering the game.
No backing a project is not pre-ordering. If the project falls through you don't get stuff or your money back, you are "investing" and getting a gift/reward from doing so. If things have changed, then they can offer up a refund if they want (not required to do so) or make some other reparation.
