    It's a 1 year warranty I believe?

I don't think they'll give you a new phone if you just "lost" yours though.

I think AppleCare covers loss/theft... but I'm assuming you don't have it anyway so you're kinda stuck.

Idk about breaking either, the factory warrenty says if any part is faulty then they will replace your phone but if you dropped it good luck...

I'm almost 90% sure you'll have to pay a replacement fee of $299-$499

I'd call an Apple store in the morning and speak to an associate or Email iTunes support.

There pretty good at getting back to you very quickly. I put in a request about a problem with my iPhone 2am on a Thursday night and someone called me from Apple at 9am the next day!

    Australia, mate!
You've got 3 months of warranty left, unless you paid for extended warranty.

Screw it. I'm just not going to bother. I never actually used it as a "Phone" anyways, I'll just get an iTouch. All I ever used it for was gaming.

Take it back, they switch it quick for a new one as long as you make an appointment. I just switched my malfunctioning 3GS in for a new one the other day. I had it for about 9 months. The warranty is good for 1 year. My new phone works great, no bugs or hardware issues like the first one I had.
