It's under the DCMA. But the DCMA has loopholes to cover unlocking of mobile phones, which you must jailbreak to do. Unless Apple decides to allow unlocked devices, it is legal. Then a new clause would have to be written about this. Apple also claims that it is redistro of copyrighted files. Also untrue. So Apple loses.
