One of the articles says that you need to get a lawyer (which is what I expected), but this article seems to think otherwise: Apparently, it is any symbol that is used to identify a company. That image is used to identify App Tech Studios (I even have a t-shirt of it ), so it should be a TM according to that article. Am I missing something? Is this article the requirements for a TM or what? Also: This means that I can put a TM on that image without registering! If I want to register, it costs money it says. You can see the article here.

Thank god I still have my copy. Gotta remember to never delete it. That sucks so much that this is it and the IGDA won. Is there any way they can change the name, and rerelease the game?
That's absolutely ridiculous. I've dealt with trademark registration and challenges in the past and I have absolutely no idea how this guy is getting away with what he is doing. As pointed out, a trademark is not just a name - it is an identity and it has to be registered to certain categories and it cannot be upheld without usage. Unfortunately, usage in this case seems to have occurred simply by people bending over for this guy when he challenges them. Even with that, with such a commonplace word, the brand identity would have to be totally challenged for this guy to have a leg to stand on and I can't see how he would show that. And, as others have pointed out, to avoid a dispute, surely all it takes is a name change?
